The partner migration program in Australia enables the spouse or de facto partner of an Australian citizen, permanent Australian resident or eligible New Zealand citizen to migrate to Australia.
To apply for an Australian Spouse Visa on the basis of your marriage, you must be legally married to your partner. If you were married in a country other than Australia and your marriage is valid in that country, generally, your marriage will be recognized as valid under Australian law as well.
To apply for an Australian Defector Visa as a de facto spouse, you and your partner generally must have been in a de facto relationship for the entire 12 months immediately prior to lodging your Australia Visa application. A de facto relationship is one where you and your partner are in a spouse-like relationship and you have a mutual commitment to a shared life together to the exclusion of all others. You must be of the opposite sex to your partner and be aged 18 years or over.
